If at any time an Ethical & Indiscipline Charge is reported against an employee following process shall be followed by the HR:-
a) Show cause notice – Any employee found indulging in misconduct, the incident shall be reported by his Reporting Head/PM to the HR. He shall be served with a show cause notice in writing by the HR. Such show cause notice shall set out in detail the alleged charges. The employee shall be required to reply to the said show cause notice in writing within a period of 3 days from the date of receipt of notice.
b) Serving of notice – Such show cause notice shall be served upon the employee either by email, in person or by speed post or Signed PDF copy by mail with cc to his supervisor and Reporting Manager
c) Failure to reply to the notice – If the employee fails to submit his/ her written explanation to the show cause notice within a period of 3 days, the management shall thereafter proceed to take appropriate disciplinary action against such an employee assuming that the alleged charges have been duly accepted by the employee.
d) Reply to the notice – If the employee submits his/ her reply to the show cause notice within the given time either denying the charge or charges or giving another version of the facts, and circumstances alleged against him/ her then, the HR, may if considered desirable shall initiate an internal enquiry in the matter. The employee shall be informed in writing the name of the enquiry officer, the venue, date and time for holding the enquiry proceedings.
e) I Internal Enquiry – The enquiry officer shall hold the proceedings as expeditiously as possible and shall submit his report and findings thereof to the HR within 7 days of initiating the enquiry proceedings. Such employee shall mandatorily make himself present in person during all enquiry proceedings at the time and place given by the HR and / or by the Enquiry Officer. If the employee fails to do so, the enquiry proceedings shall be proceeded and conducted in his / her absence. When the employee presents himself/herself before the enquiry, he/she shall be provided copies of the statement that are recorded in his presence at the enquiry.
f) Punishment – On completion of the enquiry proceedings, if the employee is found guilty of:-
i. Ethical or Moral Breach. Employee shall be terminated with immediate effect without any Notice Period or Compensation in lieu of the Notice Period.
ii. Indiscipline or Misconduct. Employee shall be awarded any of the listed punishments for his/her first offense as stated above depending upon the gravity of offense.
In case the employee is found guilty second time for the same offense or any other offense he/she shall be terminated with immediate effect without any notice or compensation in lieu of notice
